1. Scope and Application
These Terms of Service govern the provision of services and use of platforms operated by Coalition Trading 1103 CC trading as RSM Property Care & Refresh (“RSM Property Care & Refresh”, “we”, “us”, or “our”), including our website, client portal, tools, forms, and communication channels. By requesting a quotation, booking a service, accepting a quote through our portal, or using our platforms, you agree to be bound by these Terms.
2. Service Agreement
All services are subject to a confirmed quotation and agreed scope of work. No work will commence without client approval. Acceptance of a quotation through our portal or in writing constitutes agreement to these Terms in their entirety.
3. Quotations and Pricing
Quotations are based on visual assessments and information provided at the time, including satellite-based measurements where applicable. Pricing may be adjusted where:
- Site conditions differ from initial assumptions
- Physical measurements differ from satellite-based estimates
- Additional work is required
- Access limitations impact delivery
Final pricing will be confirmed prior to commencement of work.
4. Bookings and Scheduling
All bookings are subject to availability. We will make reasonable efforts to meet agreed timelines; however, delays may occur due to weather, site conditions, access issues, or operational constraints beyond our control.
5. Third-Party Services and Vendor Network
Referral Basis
- The third party operates independently
- Any agreement is solely between the client and the third party
- We accept no responsibility for their workmanship, performance, delays, or omissions
Managed or Coordinated Services
- We act as the primary point of contact for coordination
- Pricing may include a management fee or markup
- We take reasonable care in selecting providers but do not guarantee third-party work beyond their own warranties
Vendor Partner Network
RSM Property Care & Refresh operates a vendor partner network through which vetted tradespeople and contractors are allocated jobs via our portal. Vendors are independent contractors and not employees of RSM Property Care & Refresh and are required to maintain their own insurance, registrations, and compliance.
6. Client Responsibilities
The client agrees to:
- Provide accurate and complete information
- Ensure safe and reasonable access to the property
- Secure or remove valuables, fragile items, and personal belongings
- Disclose any known defects, hazards, structural concerns, or risks prior to service commencement
- Ensure surfaces to be cleaned or pressure washed are structurally sound and free of known cracks or damage
We shall not be liable for damage to unsecured or undisclosed items, or for damage arising from undisclosed defects or surface conditions.
7. Payments
Payment terms will be outlined in the quotation or invoice. We reserve the right to require a deposit prior to commencement and to suspend or delay services in the event of non-payment. All payments must be made in accordance with agreed terms.
8. Condition of Property and Pre-Existing Damage
We are not responsible for pre-existing defects, cracks, or structural issues; damage arising from underlying or hidden conditions; or issues that become visible or are exacerbated during cleaning, pressure washing, or surface preparation. Services may expose defects not previously visible. The client acknowledges and accepts this risk prior to service commencement.
9. Pre-Existing Surface Conditions and Pressure Washing — Risk Disclosure
Certain services provided by RSM Property Care & Refresh, including high-pressure cleaning, roof cleaning, driveway cleaning, and boundary wall cleaning, carry inherent risks in relation to pre-existing surface conditions. The client acknowledges and agrees that:
- Surfaces may contain hairline cracks, micro-fractures, spalling, latent deterioration, or other pre-existing defects that are not visible to the naked eye and cannot be identified through a non-invasive visual assessment
- The application of high-pressure water to surfaces containing hairline cracks or other compromised areas may result in water ingress, internal moisture damage, surface damage, paint lifting, or further deterioration of pre-existing conditions
- RSM Property Care & Refresh shall not be held liable for water ingress, internal or external damage, structural damage, or any consequential loss arising from pressure washing applied to surfaces with pre-existing hairline cracks, micro-fractures, or latent defects, whether known or unknown at the time of service
- The client accepts full responsibility for ensuring the structural soundness of all surfaces prior to service commencement
- Where the client is uncertain about the condition of any surface, they are strongly advised to obtain an independent structural assessment from a qualified engineer or contractor before proceeding
- This disclaimer applies regardless of whether the pre-existing condition was disclosed or undisclosed at the time of quotation or service
10. Risk Associated with Services
Certain services (including cleaning, pressure washing, and painting) carry inherent risks. The client acknowledges that cleaning may reveal cracks, peeling paint, or deterioration; results depend on surface condition and age; full restoration cannot be guaranteed; and high-pressure water application may exacerbate pre-existing surface conditions. We are not liable for outcomes caused by pre-existing conditions, whether disclosed or undisclosed.
11. Damage Reporting
Any claims must be reported within 24 hours of completion, in writing, with supporting photographic or documentary evidence. Failure to report within this timeframe may result in the claim not being considered.
12. Client Sign-Off and Completion
Upon completion, the client may inspect the work. If no objections are raised at completion or within 24 hours thereof, the work will be deemed accepted as satisfactory.
13. Public Liability Insurance
We maintain public liability insurance for our operations. All claims are subject to the terms, conditions, exclusions, and limits of the applicable insurance policy. Nothing in this clause extends our liability beyond what is set out in these Terms.
14. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for indirect or consequential loss
- Our liability is limited to the value of the services provided
- We are not liable for damage arising from pre-existing surface conditions, including hairline cracks and latent defects
- We are not liable for water ingress or internal damage arising from pressure washing of compromised surfaces
15. Portal Access and Use
Where access is provided to our portal (portal.rsmpropcare.com):
- Users are responsible for maintaining the confidentiality of login details
- You agree not to misuse, disrupt, or attempt unauthorized access
- Quote acceptance through the portal constitutes binding agreement to these Terms
- Digital acknowledgements and sign-offs recorded in the portal are valid and binding
- We do not guarantee uninterrupted or error-free access
16. Amendments and Governing Law
We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of any changes. These Terms are governed by the laws of the Republic of South Africa.
